Article 16-Equality of opportunity in matters of public employment
(1) State ke under sabhi offices me employment ke liye sabhi citizens me equality hogi.
(2) State ke under kisi office ke liye koi person sirf religion, race, caste, sex, descent, place of birth, residence ya inme se kisi ke basis par ineligible nahi hoga aur na hi usme discrimination kiya jayega.
(3) Is article ki koi baat parliament ko koi aisa law banane se nahi rok sakti jo kisi state ya union territory ki job ke liye uss state ya union territory me pehle se residence ki requirement karta ho.
(4) Upar kahi baton ke bawajood agar state ko lagta hai ki state jobs me backward class citizens ka sahi representation nahi hai to woh backward class citizens ke favour me job me reservation ke liye provisions bana sakta hai.
(4A) Upar kahi baton ke bawajood agar state ko lagta hai ki state jobs me SC, STs ka sahi representation nahi hai toh wo promotion with consequential seniority ke matter me SC, STs ke reservation ke liye provisions bana sakta hai.
(4B) Agar clause 4 aur 4A ki reserved vacancies me se previous year kuch unfilled reh gayi thi toh state unhe next year me ek separate class of vacancy consider kar sakega aur un par 50% ki ceiling bhi lagu nahi hogi.
(5) Upar kahi gayi bato ke baad bhi aisa koi law valid hoga jo ye kehta ho ki kisi religious ya denominational institute ke work se related koi person ya uski governing body ka koi member kisi specific religion se ho ya specific denomination se ho.
(6) Upar kahi gayi baton ke baad bhi, state economically weaker citizens ke liye job me reservations ke liye provisions bana sakta hai jo each job category ke liye maximum 10% hoga. Ye economically weaker sections clause 4 me mention backward citizens se alag honge aur ye reservation already existing reservation se alag hoga.
