Article 13-Laws inconsistent with or in derogation of the fundamental rights.
(1) Constitution ke implement hone se pehle ke sabhi laws wahan tak invalid honge jahan tak wo is part ke provisions se inconsistent honge.
(2) State koi aisa law nahi banayega jo is part dwara provided rights ko reduce karta ho ya snatch karta ho or is tarah se banaya gaya koi law inconsistency ki limit tak invalid hoga.
(3) Is article me,—
(a) “law” ki definition me include hoga India ki territory me law ki power rakhne wala koi Ordinance, order, bye-law, rule, regulation, notification, custom or usage;
(b) “laws in force” me include hoga constitution se pehle India ki territory me kisi legislature ya competent authority dwara banaya gaya koi law jise khatam nahi kiya gaya ho. Bawajood iske ki wo law ya uska koi part kisi jagah implement nahi ho paya tha.
(4) Is article ki koi baat article 368 ke under me kiye gaye constitution ke amendment pe implement nahi hogi. *(means amendment ko law nahi samjha jayega, warna to good intention ke bawajood constitution ko amend karna difficult hoga)
